Your rights to mental health medical leave in Malaysia — what the law actually says

by Ernie Zulkifli·May 21, 2026

Not legal advice, please consult a lawyer or HR professional for your specific situation. But here's what I've researched and confirmed.

The Employment Act 1955:
Medical leave entitlement is 14—22 days per year depending on years of service. The act doesn't specify "mental health" vs "physical health", medical leave is medical leave, provided by a registered medical practitioner.

In practice:
A doctor can issue MC (medical certificate) for mental health conditions including anxiety, depression, or burnout. You do not need to disclose your specific diagnosis to your employer, the MC is sufficient.

What employees get wrong:
Believing they can only take MC for visible physical illness. A licensed GP can issue MC for any health condition including mental health. Specialist (psychiatrist/psychologist) referrals are also valid.

Recommendation:
If you need rest for mental health reasons, see a GP. Be honest with the doctor. They can issue MC and connect you with appropriate resources.

My daughter is 17 and choosing between medicine and engineering. My advice: shadow professionals in both fields for one week each before deciding. Theory is misleading.

The parental pressure to choose "safe" careers, doctor, lawyer, engineer, ignores that many of these fields are being disrupted. The safe choice is the one you'll be good at.

Career aptitude tests are not perfect but doing a few different ones and looking for patterns is more useful than guessing based on what jobs sound impressive.
