Employment Law, Policy & Worker Rights

Most workers in Peninsular Malaysia are covered by the Employment Act 1955, amended in 2022. Sabah and Sarawak have their own labour ordinances. These guides explain what the law gives you and what an employer can and cannot do.

Know your baseline rights. The Employment Act 1955 explained is the foundation. Specific guides cover minimum wage, overtime and working hours, annual leave and public holidays, every type of leave, and maternity and paternity leave.

Read before you sign. How to read an employment contract and what a Malaysian employment contract must include show what to check. If you are leaving, notice periods and resignation sets out what you owe the employer, and what it owes you.

If you are dismissed or laid off. Read termination and dismissal rights, retrenchment and layoffs, and unfair dismissal at the Industrial Court. Disciplinary action and misconduct covers the process an employer must follow.

A safe workplace. See sexual harassment laws, workplace bullying, workplace safety under OSHA and mental health at work.

New ways of working. Read about the gig workers law, moonlighting, freelancer tax and influencer tax.

These guides explain the law in plain language. They are not legal advice. For a dispute, contact the Labour Department (JTK) or a lawyer.
