Laid Off in Malaysia? Your Step-by-Step Recovery Plan

By SuperJobs Team
Quick Answer: The Employment Insurance System run by PERKESO can replace part of your income after a layoff, but its Job Search Allowance is not automatic. It is gated by PERKESO's Contributions Qualifying Conditions, a minimum contribution record held before the job loss, so if you have under two years of private-sector payroll contributions, check your eligibility before counting on the money. If you clear the gate, the allowance runs for three to six months at 80 per cent of your assumed monthly wage in the first eligible month, then 50, 40, 40, 30 and 30 per cent, calculated on the wage held in your PERKESO record rather than your last payslip. PERKESO requires the application within 60 days from the date of loss of employment. Apply at lindungkerjaya.perkeso.gov.my.
You are told on a Tuesday morning. By lunchtime there is a letter, a last working day and a figure you were not expecting to read. The next hour is not for opening LinkedIn. It is for photographing the letter, saving a copy somewhere that is not your work laptop, and writing down three dates: your last working day, the day your company medical cover stops, and the day your final payment lands.
PERKESO's Employment Insurance page states the deadline in one line: apply within 60 days from the date of loss of employment. The portal then asks for four things: your NRIC front and back, proof of termination such as a termination letter, retrenchment notice or VSS agreement, six months of payslips, and a copy of your personal bank account statement.
This article is general information, not legal or tax advice. Rates, thresholds and submission windows change. Confirm your position with PERKESO, LHDN or a qualified adviser before acting on any figure here.
Understanding Your Legal Rights: Retrenchment vs Termination
The two words get used interchangeably in WhatsApp groups and mean different things on paper. Retrenchment is the job going away: the function is closed, merged or moved, and the person holding it goes with it. Termination for misconduct is an allegation about you. Resignation is your decision. The wording in your letter drives what you can claim.
PERKESO tests the reason for your job loss against the definitions in the Employment Insurance System Act 2017, known as Act 800. Its guidance is blunt about the boundary: voluntary resignation is generally not treated as a loss of employment. The named exceptions matter, because people assume they have no claim when they do. PERKESO's EIS portal lists resignation under a mutual separation scheme agreed with the employer, resignation because the employer breached the employment contract, resignation after threats against you or your family, resignation after being ordered to perform unsafe work, and job loss because the workplace shut down through natural disaster or riots.
The law behind retrenchment selection, notice periods and unfair dismissal claims sits outside this guide on purpose. Read our breakdown of retrenchment and layoff rights in Malaysia for the Employment Act 1955 position, last-in-first-out selection and what to do if the process looks unfair.
One move before you leave. Ask for the letter to state the reason as retrenchment or redundancy in plain words, and keep six months of payslips. Both go into your EIS file. Then browse jobs across Malaysia to see what your role currently pays.
VSS, Retrenchment Benefits and Notice Pay
Your payout has two layers, and reading them as one is how people sign away the difference. The top layer is whatever your contract and your employer's scheme offer. Underneath it sits a statutory floor.
That floor is set by the Employment (Termination and Lay-Off Benefits) Regulations 1980, made under the Employment Act 1955. Two features of it decide your number. Termination benefit is calculated from your completed years of service, so it scales with tenure rather than arriving as a flat sum, and a short first job produces a small statutory figure. And it is a minimum, not a target: a voluntary separation scheme can pay well above the Regulations and frequently does, but it cannot lawfully pay a covered employee less than the statutory entitlement already held.
Coverage is geographic as well as contractual. The Employment Act 1955 and the Department of Labour Peninsular Malaysia (JTKSM), under the Ministry of Human Resources, cover private-sector employees in the peninsula, while employees in Sabah and Sarawak fall under their own labour ordinances and their own labour departments. Which employees attract which sections of the Act has been amended more than once, so confirm your own coverage with JTKSM or the Ministry of Human Resources general line on 03-8880 6200. For the day-count per completed year of service and how it sits against notice pay, our retrenchment and layoff rights guide runs the full calculation.
Four items decide your cash runway: your last working day and whether you serve notice or are paid in lieu, the termination payment as a gross figure with the basis of calculation shown, any accrued annual leave cashed out, and the date your company medical cover ends.
A voluntary separation scheme is a negotiated exit, not a resignation letter with a bonus. PERKESO's covered situations include leaving under a mutual separation scheme agreed with the employer, and a VSS agreement is accepted as proof of termination. Keep the signed agreement.
If your employer has not paid what the letter promised, JTKSM handles labour complaints for private-sector employees in the peninsula. Go with the letter, the payslips and the bank statement.
Filing an EIS Claim With PERKESO
Plenty of people who qualify never claim, either assuming EIS is only for factory retrenchments or unable to face another government portal in the same week. If you contributed under Act 800 through a private-sector payroll, this is money you and your employer already paid in.
PERKESO's stated conditions for Job Search Allowance: you are a Malaysian citizen, permanent resident or temporary resident; you worked in the private sector or as a domestic worker; you are aged 18 to 60, except that individuals aged 57 and above with no prior contribution history are excluded; you are registered under Act 800; you satisfy the Contributions Qualifying Conditions; your job loss meets the Act 800 definition; and you are able, willing and actively seeking work.
That last condition is not decorative. Keep evidence of your applications from day one.
Whether you qualify at all
The condition about contributions decides every other number in this section. Job Search Allowance is gated by PERKESO's Contributions Qualifying Conditions, a minimum count of monthly contributions held within a set period before you lost the job, and PERKESO's public pages state the requirement without publishing the count. Ask for yours on the careline before you build a budget around it.
For anyone one or two years into a first job the consequence is blunt. A handful of months of contributions may not clear the gate at all, and where it does clear, that same record decides whether you are paid for three months or six. Nobody is entitled to the allowance by virtue of having been retrenched.
What EIS actually pays
| Benefit | What it provides |
|---|---|
| Job Search Allowance (Elaun Mencari Pekerjaan) | Monthly payment for 3 to 6 months at 80%, 50%, 40%, 40%, 30% and 30% of assumed monthly wage by eligibility month |
| Early Re-Employment Allowance | Lump sum of 25% of the Job Search Allowance you are eligible for but have not yet been paid |
| Reduced Income Allowance | One-off payment for those who lost one of multiple jobs |
| Training Allowance | RM10 to RM20 per day while attending approved training |
| Training Fee | Up to RM4,000 for an approved training programme |

Assumed monthly wage is the figure in your PERKESO contribution record, not the number on your last payslip, and the two are not always the same. Ask PERKESO what it holds for you before turning 80 per cent into a monthly budget.
Read the Early Re-Employment Allowance row twice. It exists so that taking a job in month two does not feel like walking away from months three to six, which is the trap that keeps people waiting for an offer they cannot afford to wait for.
The 60-day deadline
PERKESO's Employment Insurance page carries the rule without qualification: apply within 60 days from the date of loss of employment. The clock runs from the loss-of-employment date, so establish that date in writing with your employer, and do not assume it is the day your final payment clears.
Sixty days is not an invitation to wait. PERKESO's EIS FAQ puts approval at roughly five to fourteen working days after a complete submission, which means a claim filed on day 55 with a missing payslip has nowhere to go. File in the same week the letter is issued. Anything specific to your case can be confirmed at lindungkerjaya.perkeso.gov.my, on the PERKESO careline 1-300-22-8000, or by email to perkeso@perkeso.gov.my.
PERKESO also runs MYFutureJobs, its own job-matching and career services platform. Registering costs nothing and creates a documented job-search trail.
Tax Implications of Severance in Malaysia
A retrenchment payment is not automatically tax-free. LHDN's guidance on individual income tax lists gratuity, including deferred payment on termination of employment that is not exempted under any provision of the Act, among taxable employment income. Leave pay received in advance on termination is treated the same way.
Exemptions do exist. Compensation for loss of employment is dealt with under Schedule 6 of the Income Tax Act 1967, and the Director General's interpretation is set out in LHDN Public Ruling No. 1/2012, Compensation For Loss Of Employment, issued on 27 January 2012 and still listed in HASiL's public rulings archive. The exempt amount per completed year of service has been revised over the years, and the only version that matters is the one in force for your year of assessment, so take it from LHDN Customer Care on 03-8911 1000, a HASiL branch, or the ruling itself on hasil.gov.my.
Two points hold regardless of the figure. Your employer reports the payment on your EA form, and the taxable and exempt portions should be shown separately, so check the split against your letter. And monthly tax deduction on a large one-off payment is often heavier than your eventual liability, especially if you are out of work for part of the year. That difference comes back as a refund only if you file.
Keep the termination letter, the EA form and the bank credit advice in one folder.
EPF, SOCSO and Health Insurance Between Jobs
Losing the salary does not empty the accounts, but it stops several things at once, on different dates.
Your EPF account stays open. The balance remains yours and continues to earn whatever dividend KWSP declares for the year. What stops is the monthly employer and employee contribution, because there is no wage to contribute from. KWSP operates voluntary contribution arrangements for people who are not on a payroll, and the rules and annual limits get reviewed, so check kwsp.gov.my or a KWSP branch rather than trusting a WhatsApp forward. Treat early withdrawal of retirement savings as the last option, and only after counting how many months your final payment covers.
SOCSO and EIS contributions also stop with the salary. What survives is your contribution record, and that record is what qualifies your EIS claim. Check it before you apply. Missing months usually mean a payroll reporting gap on the employer side, and it is easier to raise that while your former HR team still recognises your name.
Company medical cover catches people out. Group hospitalisation and outpatient benefits typically end on a date named in your letter, and for many schemes that date is your last working day. If you or a dependant is mid-treatment, ask HR before you leave whether the policy allows conversion to an individual plan or a short extension.
One task for week one: download six months of payslips and your EPF and SOCSO statements while you still have access to company systems.
30-Day Job Search Sprint After a Layoff
This is built for someone watching their bank balance, not someone with unlimited energy. Cap your search at three to four focused hours a day. Beyond that you are not searching, you are worrying with a browser open.
Days 1 to 7: paperwork before applications. File the EIS claim, well inside the 60 days. Write down every fixed monthly cost, divide your final payment by that number, and you have your runway in months. Tell two people who will actually help. Update one CV, not five versions, and run it through the free CV checker. No applications yet.
Days 8 to 14: fifteen good applications, not a hundred bad ones. Pick roles where you meet most of the requirements and can name a reason you want them. Message ten former colleagues individually with a concrete ask. Rewrite your LinkedIn headline and About section with the LinkedIn optimizer, because recruiters searching for your skills will not find a headline carrying an old job title and nothing else.
Days 15 to 21: interviews and numbers. First interviews usually land here. Rehearse the layoff answer out loud until it bores you, which is the point. Check what your role pays on SuperJobs salary insights so the expected salary question does not catch you at your weakest moment.
Days 22 to 30: widen the shape of the search. Add adjacent job titles, smaller companies and other states. Look seriously at contract jobs in Malaysia, because a three or six month contract restarts income, keeps your EPF and SOCSO contributions running, and reads as continuous employment on a CV. If the gap you keep hitting is a missing skill rather than a slow market, ask PERKESO about the Training Fee of up to RM4,000.
If day 30 arrives with no offer, that is not failure. Offers rarely land in the same week you apply.
How to Talk About Being Laid Off in Interviews
A Malaysian hiring manager asks about a retrenchment to check the facts, not to hear an apology. Answer in three sentences: what happened, why it happened in neutral structural terms, and what you want next.
A restructured team:
My role was part of a function restructured in March. The whole team was affected, so it was a headcount decision rather than a performance one. I am looking for a role where I can keep doing supply chain analysis, which is what I was strongest at.
A completed project:
The project I was hired onto finished and the company decided not to open a second phase. My contract ended with it. I closed out the handover documentation, and I am looking for a permanent role in the same field.
A company-wide cost reduction:
The company reduced headcount across several departments this year and my position was one of them. I worked through my notice. I am focusing my search on companies actively investing in this area.
Ask your manager for a reference letter before your last day, and confirm what HR will state on a verification call, usually job title and employment dates. Never adjust your dates on a CV, because a background check confirms them.
Mental Health and Support Resources
The money problem has a spreadsheet. The identity problem does not, and it is the one that stops people filing the EIS claim in the week it should be filed. Changes lasting more than two weeks in sleep, appetite or concentration are a reason to talk to a professional, not something to push through.
These Malaysian services are free or low cost:
- Befrienders Kuala Lumpur, 03-7627 2929. A 24-hour emotional support line, free and confidential, staffed by trained volunteers for anyone in distress or having suicidal thoughts.
- Malaysian Mental Health Association (MMHA), 03-2780 6803, Monday to Friday 9am to 5pm, or admin@mmha.org.my.
- MENTARI, the Ministry of Health's community mental health programme. MENTARI HQ is on 03-6127 0946, with services through MOH facilities nationwide.
- Talian Kasih, 15999, or WhatsApp 019-261 5999. The Ministry of Women, Family and Community Development's 24-hour national helpline for individuals and families in crisis, covering welfare, abuse and family cases. If what you need is someone to talk to, call Befrienders.
If you are in immediate danger, call 999.
Being retrenched is not a verdict on your work. It is a decision someone made about a budget line that had your job title on it.
Frequently Asked Questions
How do I claim EIS Job Search Allowance after being laid off in Malaysia?
Apply through PERKESO's EIS portal at lindungkerjaya.perkeso.gov.my within 60 days from the date of loss of employment, the deadline PERKESO states on its Employment Insurance page. You need your NRIC copy front and back, proof of termination such as a termination letter, retrenchment notice or VSS agreement, payslips for the six months before the job loss, and a personal bank account statement. Questions go to the careline on 1-300-22-8000.
How much does EIS Job Search Allowance pay?
Job Search Allowance is not automatic. You must first satisfy PERKESO's Contributions Qualifying Conditions, a minimum contribution record, and many people with under two years of payroll contributions do not qualify. If you do, PERKESO pays monthly for three to six months, at 80 per cent of your assumed monthly wage in the first eligible month, then 50, 40, 40, 30 and 30 per cent. Assumed wage comes from your PERKESO record, not your last payslip.
Is severance pay taxable in Malaysia?
Compensation for loss of employment is not automatically tax-free. LHDN treats gratuity and payments on termination as employment income unless the Income Tax Act 1967 exempts them. The exemptions sit in Schedule 6, and Public Ruling No. 1/2012 explains how they apply. The exempt amount has changed over the years, so confirm the current figure with LHDN Customer Care on 03-8911 1000.
Does resigning under a VSS qualify for EIS in Malaysia?
PERKESO says voluntary resignation is generally not a loss of employment, but lists exceptions. Leaving under a mutual separation scheme agreed with the employer counts, as do resignations caused by the employer breaching the contract, threats against you or your family, orders to perform unsafe work, or the workplace closing through natural disaster or riots. Keep the signed VSS agreement.
What happens to my EPF and SOCSO when I lose my job?
Your EPF account stays open and the balance keeps earning the dividend KWSP declares, but contributions stop because there is no wage. KWSP offers voluntary contribution arrangements for people not on a payroll, so confirm eligibility and limits with KWSP directly. SOCSO and EIS contributions stop too, but your contribution record remains and qualifies your EIS claim.
How do I explain being laid off in a job interview?
Keep it to three sentences: what happened, why it happened in neutral structural terms, and what you want next. Say the function was restructured, that the whole team was affected so it was a headcount decision rather than a performance one, and name the role you want. Do not criticise your former employer or adjust your employment dates.
